1. Introduction

Welcome to Coloromi ("we," "our," or "us"). By accessing or using our website (coloromi.com), mobile applications (including our iOS app), and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Coloromi regarding your use of the Services.

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

By using our Services, you represent and warrant that:

You are at least 13 years of age (or the minimum legal age in your jurisdiction to use online services)
If you are under 18 years old, you have your parent's or legal guardian's permission to use the Services and they have read and agree to these Terms on your behalf
You have the full right, power, and authority to agree to and be bound by these Terms
You are not prohibited from using the Services under the laws of the United States or any other applicable jurisdiction

3. Account Registration

To access certain features of our Services, you may need to register for an account. You can register using email and password or through Sign in with Apple (on supported platforms). When registering, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password secure and confidential (for email/password accounts)
Manage your Sign in with Apple settings through your Apple ID account (for Apple sign-in accounts)
Notify us immediately of any unauthorized access to or use of your account
Take responsibility for all activities that occur under your account

We reserve the right to disable any user account at any time, including if we believe you have violated these Terms.

3.1 Email Verification

We may require email verification as part of the registration process. You agree to receive a verification email and complete the verification process to fully activate your account. If you do not verify your email within the specified timeframe, certain features of your account may be limited.

3.2 Account Security

For your account security, we implement the following measures:

Rate limiting on login attempts to prevent unauthorized access
Password encryption using bcrypt technology
Automatic account lockouts after multiple failed login attempts
Session management to protect against unauthorized access

You are responsible for maintaining the security of your account credentials and must notify us immediately of any unauthorized access.

4. Service Tiers and Payment Systems

4.1 Free Tier

Our free tier includes:

1 free credit upon account creation for AI coloring page generation
Access to basic coloring page generation features
Full access to the Vault with 2 uploads per day
1 download per day from your vault
Complete community participation in the Coloring Wall (sharing, likes, comments, follows)
Collection creation and management
Achievement system and badges
All social features and community interactions
Individual privacy controls for each piece of content

4.2 Credit System

Our Services operate on a credit-based system for AI coloring page generation subject to the following terms:

Each credit allows for the generation of one coloring page
Credits must be purchased through our platform or App Store (for mobile users)
Credits do not expire and remain valid until used
Credits are non-transferable and non-refundable, except as required by law
We reserve the right to modify the credit system, including pricing and functionality, at any time

4.3 Vault Subscription Service

Our premium Vault subscription service removes daily limits and provides enhanced features:

Unlimited high-quality artwork uploads to your personal vault (vs. 2 per day for free users)
Unlimited downloads from your vault (vs. 1 per day for free users)
Advanced upload processing including automatic compression, thumbnail generation, and quality optimization
Priority processing and faster upload speeds
Priority customer support
Access to exclusive content and early feature previews
Ad-free experience (when applicable)
Enhanced storage and backup features

All community features are available to both free and premium users, including:

Personal vault storage for finished coloring pages with detailed metadata
Collection creation and management tools for organizing artwork into themed galleries
Community features including sharing artwork publicly on the Coloring Wall
Community interaction features including upvotes, comments, follows, and favorites
Achievement system with admin-awarded badges for quality artwork and community participation
Individual privacy controls for each piece of content (comments, likes, saving, sharing permissions)
Featured artwork capabilities to highlight your best work on your profile
Social media usage consent controls for shared content
Access to community dashboard and statistics

Free User Limitations:

Limited to 2 vault uploads per day
Limited to 1 download per day from vault
May see advertisements (we reserve the right to show ads to free users)
Standard processing priority

4.4 Free Trial

We may offer free trial periods for our Vault subscription service. During the trial period:

You have access to all Vault features at no charge
The trial will automatically convert to a paid subscription unless cancelled
You may cancel at any time during the trial period to avoid charges
If you cancel during the trial, you retain access until the trial period ends
Trial periods are limited to one per user and cannot be extended or repeated

4.5 Payment Processing

We use Stripe as our payment processor for all platforms:

Web Platform: Stripe processes payments for web-based purchases and subscriptions
iOS App: Stripe processes payments with Apple Pay available as a secure payment method option

By making a purchase or subscribing, you agree to provide current, complete, and accurate payment information and authorize us to charge your chosen payment method for the products or services you have selected.

All prices are in US dollars unless stated otherwise. We reserve the right to adjust pricing at any time with reasonable notice. Applicable taxes may be added to the purchase price as required by law.

4.6 Subscription Management

For Vault subscriptions:

Subscriptions automatically renew unless cancelled
All platforms: You may cancel through your account settings on our website or mobile app
Cancellations take effect at the end of the current billing period
You retain access to unlimited features until the subscription expires, then revert to free tier limits
We may offer promotional pricing or discounts at our discretion

4.7 Refunds

Due to the digital nature of our Services, all purchases are final and non-refundable, except in cases where:

The Services are unavailable for an extended period
We have made material changes to the Services that substantially reduce their functionality
Refunds are required by law
You cancel during a free trial period

Refund requests should be submitted to [email protected] within 7 days of purchase.

5. User Content and Community Features

5.1 Content Ownership

You retain ownership of any images you upload to our Services ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, modify, create derivative works (such as coloring pages), and distribute your User Content for the purposes of operating, developing, and improving our Services.

5.2 Public Sharing and Coloring Wall

Our Coloring Wall is a community feature where users can share their finished artwork. By participating in the Coloring Wall, you agree that:

Content you mark as public will be visible to other users and may appear in community galleries
Other users may interact with your content through likes, comments, follows, and other social features
Your public profile information may be visible to other users
You may receive notifications about community interactions with your content
You can control the visibility of your content through privacy settings

5.3 Collections and Organization

Vault subscribers can create and manage collections to organize their artwork:

Collections can be kept private or shared publicly with the community
You retain full control over your collection content and organization
Public collections may be featured in community showcases
Other users may favorite, upvote, or share your public collections
Collection titles and descriptions are subject to our content guidelines

5.4 Social Features

Our Services include various social features that allow users to interact:

Following: You may follow other users to see their public content and activity
Upvotes: You may upvote artwork you appreciate, with counts displayed publicly
Comments: You may comment on public content where enabled by the creator
Sharing: You may share public content through social media or direct links
Favorites: You may save public content and collections to your personal favorites list
Collections: Vault subscribers may create public collections that other users can favorite and upvote
Achievements: You may earn badges and achievements through community participation, awarded by administrators
Featured Content: You may feature your best artwork on your profile to highlight your work
Privacy Controls: You may control interaction permissions (comments, likes, saving, sharing) for each piece of content individually
Community Rankings: Users earn ranks based on their community participation and achievement levels
Reporting System: You may report inappropriate content or behavior for moderation review

5.5 Content Restrictions

You agree not to upload, transmit, or share User Content that:

Infringes upon intellectual property rights of any third party
Contains explicit, graphic, or inappropriate content (including nudity, violence, or offensive material)
Depicts recognizable individuals without their consent (or parental consent for minors)
Promotes discrimination, bigotry, racism, hatred, or harm against any individual or group
Is intended to harass, intimidate, or bully
Contains personal or confidential information of another person
Promotes illegal activities or contains malicious code
Violates any applicable law, regulation, or third-party right
Contains spam, misleading information, or commercial solicitation
Impersonates another person or entity

We reserve the right to review, remove, or restrict access to User Content that violates these Terms or that we otherwise find objectionable, without prior notice.

5.6 Content Moderation

All user-uploaded content is subject to moderation:

Automated moderation using AI-based recognition technology (AWS Rekognition) to detect inappropriate content including nudity, violence, or offensive material
Manual review by our moderation team when necessary or when automated systems flag content
Community reporting system for inappropriate content with categories for different types of violations
Appeals process for moderation decisions with detailed rejection reasons provided
Progressive enforcement including warnings, content removal, temporary hiding, and account restrictions
Upload status tracking (PROCESSING, COMPLETED, FAILED, MODERATION_FAILED) with detailed feedback
Admin-awarded achievements and recognition for exceptional community contributions
Temporary content hiding for reported items pending review

Images that fail our moderation checks will be automatically rejected with specific reasons provided, and repeated violations may result in account suspension or termination.

5.7 Community Guidelines

To maintain a positive community environment, users must:

Treat other users with respect and kindness
Provide constructive feedback and avoid harassment
Respect intellectual property and attribution rights
Report inappropriate content or behavior
Follow age-appropriate content standards
Avoid spam, self-promotion, or commercial activities without permission

5.8 Data Retention

We may retain your User Content and any derivatives for as long as reasonably necessary for the purposes described in these Terms. Even after you delete your account:

Your private content will be permanently deleted
Public content may remain on the site to maintain community integrity
Your username may be retained for attribution purposes
Community interactions and contributions may remain visible

6. Intellectual Property Rights

6.1 Our Content

The Services, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software), are owned by Coloromi, our licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

6.2 Generated Coloring Pages

The coloring pages generated through our Services are for personal, non-commercial use only, unless you purchase a commercial license. With a personal license, you may:

Print coloring pages for personal use
Share printed coloring pages with family and friends
Use coloring pages for educational purposes in non-commercial settings
Share digital versions through our community features
Create and share colored versions through our platform

You may not:

Redistribute, sell, or offer generated coloring pages through any other website, application, or service
Use the generated coloring pages for commercial purposes without a commercial license
Remove watermarks or attribution from generated coloring pages
Claim ownership or authorship of generated coloring pages
Use automated tools to mass-download or scrape content

6.3 AI-Generated Content

The coloring pages generated by our AI technology may be based on multiple sources and training data. By using our Services, you acknowledge that:

AI-generated coloring pages do not infringe on any third-party copyright by nature of their transformation and original creation
We cannot guarantee absolute uniqueness of every generated design
While you receive a license to use the coloring pages as specified in these Terms, the underlying AI models and generation technology remain our property
Our AI models are trained on properly licensed data and have been designed to create original content rather than reproduce existing works

6.4 User-Generated Collections and Artwork

You retain ownership of colored versions you create using our Services, subject to the limitations on the underlying coloring page rights described in these Terms. For collections and community content:

You retain rights to the organization and curation of your collections
Public collections may be featured or promoted by us with attribution
You grant other users the right to view, favorite, and share your public content
You may not claim exclusive rights to community features or social interactions

7. Prohibited Activities

You agree not to:

Use the Services in any manner that could disable, overburden, damage, or impair the Services
Use automated scripts, bots, or other software to access or interact with our Services
Attempt to circumvent any access restrictions, security measures, or subscription limitations
Engage in any activity that interferes with or disrupts the Services or community
Use the Services to develop competing products or services
Attempt to decompile, reverse engineer, or disassemble any portion of our Services
Use the Services for any illegal purpose or in violation of any law
Impersonate another person or misrepresent your affiliation with any person or entity
Attempt to bypass our rate limits, content moderation, or anti-abuse measures
Create multiple accounts to circumvent usage limitations or account restrictions
Engage in excessive downloading of content using automated means
Conduct systematic scraping of our website, galleries, or community content
Manipulate community features through fake accounts, vote manipulation, or artificial engagement
Harass, stalk, or intimidate other users
Share or distribute malicious content or links

7.1 Rate Limiting and Usage Restrictions

To ensure fair usage of our Services, we implement various rate limits, including but not limited to:

API request limits (60 requests per minute for authenticated users, 20 requests per minute for anonymous users)
Login attempt limits (10 login attempts per 5 minutes)
Registration limits (3 new accounts per hour from the same IP address)
Upload limits (hourly upload limits for vault content, configurable by system administrators)
Download limits (10 downloads per minute for anonymous users, 20 downloads per minute for authenticated users)
Daily vault download limits (1 download per day for expired subscribers, unlimited for active subscribers)
Community interaction limits to prevent spam and abuse
Collection creation and management limits based on subscription tier
Comment and upvote rate limits to prevent automated engagement
File size limits (10MB maximum for vault uploads)
Supported file types (JPEG, PNG, WebP only for vault uploads)

Exceeding these limits may result in temporary restrictions on your ability to use certain features of the Services.

7.2 Account Restrictions and Enforcement

We may restrict your account in various ways if we detect violations of these Terms or suspicious activity:

Hard Ban: Complete restriction of account access
Soft Ban: Silent restriction of specific actions without notifying you
Feature-specific Restrictions: Limiting your ability to generate content, participate in community features, or access Vault services
Community Restrictions: Limiting your ability to post, comment, or interact with other users
IP Ban: Restricting access from specific IP addresses in cases of systematic abuse
Subscription Suspension: Temporary or permanent suspension of Vault subscription benefits

Repeated or severe violations may result in permanent account termination and forfeiture of subscription benefits.

8. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information when you use our Services. By using our Services, you consent to the collection, use, and sharing of your information as outlined in our Privacy Policy.

8.1 Data Collection and Processing

We collect and process various types of information to provide our Services:

Account information (name, email, password, profile details)
Subscription and payment information
User-uploaded images and generated coloring pages
Community interactions and social activities
Usage data and interaction with our Services
Device information and analytics data

We implement appropriate technical and organizational measures to protect your personal information against unauthorized or unlawful processing.

8.2 Community Data and Public Information

When you participate in community features:

Your public profile and content may be visible to other users
Your community interactions may be tracked for analytics and moderation
We may use aggregated community data to improve our Services
You can control the visibility of your information through privacy settings

8.3 Cookies and Similar Technologies

Our website uses cookies and similar technologies to enhance your browsing experience and analyze site usage. When you first visit our site, you will be presented with a cookie consent banner that allows you to choose which types of cookies you accept. Your choice will be stored and respected throughout your use of our Services.

App Tracking Transparency (ATT) on iOS

We use Apple’s App Tracking Transparency framework to request your consent for advertising tracking on iOS. You may decline tracking at any time, and we will respect your choice. If you decline, advertising cookies and tracking technologies (such as Facebook Pixel) will not be used for advertising or cross-site tracking.

9. iOS App and Apple Services

When you use our iOS mobile application, additional terms apply:

9.1 App Store Terms

Your use of our iOS app is also governed by Apple's App Store Terms and Conditions. In case of conflict between these Terms and Apple's terms, Apple's terms take precedence for App Store-related matters.

9.2 Sign in with Apple

If you use Sign in with Apple:

You agree to Apple's terms for Sign in with Apple
You can manage your Sign in with Apple settings through your Apple ID account
We will respect your privacy choices, including private relay email addresses
You can revoke access at any time through your Apple ID settings

9.3 iOS App Payments

For purchases made through the iOS app:

All payments are processed by Stripe, with Apple Pay available as a payment method
Subscriptions are managed through your account settings in our app or website
Refund requests should be made through our support system, subject to our refund policy
Auto-renewal settings are controlled through your account settings
Apple Pay provides enhanced security without sharing card details directly with us

9.4 Device Permissions

Our iOS app may request access to certain device features:

Photos: To allow you to upload images from your photo library
Camera: To take photos for upload (if implemented)
Notifications: To send you updates about your account and community activity

You can manage these permissions through iOS Settings at any time.

10. Third-Party Services and Integrations

Our Services may integrate with or contain links to third-party websites or services. We do not control and are not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge that your use of such third-party services is governed by their terms of service and privacy policies.

10.1 Third-Party Integrations

Our Services use the following third-party services and integrations:

Stripe: For payment processing and subscription management across all platforms
Apple: For Apple Pay payment method integration and Sign in with Apple authentication
AWS S3: For storage of user-uploaded images and generated coloring pages
AWS Rekognition: For content moderation of user-uploaded images
OpenAI API: For AI-powered coloring page generation
Redis/Upstash: For rate limiting, caching, and session management
Social Media Platforms: For sharing and social login features (when available)

Your use of these third-party services is subject to their respective terms and privacy policies.

11. Disclaimers

11.1 No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11.2 AI-Generated Content

The coloring pages generated by our Services use artificial intelligence technology, which may produce unexpected or imperfect results. We do not guarantee that the generated coloring pages will meet your specific requirements or expectations.

11.3 Community Content

We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any community content or communications posted through our Services. You acknowledge that any reliance on community content is at your own risk.

11.4 Content Moderation

While we employ automated and manual systems to detect inappropriate content, these systems are not infallible. We do not guarantee that all inappropriate content will be detected or that appropriate content will not be erroneously flagged.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COLOROMI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
ANY CONTENT OBTAINED FROM THE SERVICES
UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
COMMUNITY INTERACTIONS OR USER-GENERATED CONTENT
SUBSCRIPTION INTERRUPTIONS OR SERVICE CHANGES
APP STORE OR APPLE-RELATED SERVICES AND TRANSACTIONS

IN ANY EVENT, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO COLOROMI DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to defend, indemnify, and hold harmless Coloromi, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

Your use of and access to the Services
Your violation of any term of these Terms
Your violation of any third-party right, including without limitation any copyright, property, or privacy right
Any claim that your User Content caused damage to a third party
Your community interactions and participation in social features
Your use of Vault services or subscription features
Your use of iOS app or Apple services

14. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If your account is terminated:

Your access to Vault services will be immediately revoked
Your private content may be deleted
Your subscription will be cancelled (refunds subject to our refund policy)
Your community contributions may remain but will be dissociated from your account
You will lose access to any purchased credits or subscription benefits

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14.1 Account Deletion

You may request deletion of your account through your account settings. Upon deletion:

Your personal information will be removed from our active databases
Your private vault content will be permanently deleted
Your private coloring pages will be deleted
Public content and community contributions will remain on the site
Your username may be retained to preserve attribution of public content
Subscription and payment history may be retained as required by law
Usage logs and anonymized data may be retained for analytics purposes

We will process your account deletion request within 30 days. We recommend canceling any active subscriptions through your account settings before deletion.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any changes by updating the "Last Updated" date at the top of these Terms and, for significant changes, through additional notification methods such as email or prominent notices on our Services.

Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue your use of the Services.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Services shall be finally settled by binding arbitration. The arbitration shall be conducted under the rules of the American Arbitration Association and judgment on the arbitration award may be entered in any court having jurisdiction.

Any arbitration under these Terms will take place on an individual basis; class arbitrations and class actions are not permitted.

Note: For payments made using Apple Pay, Apple's payment processing terms may apply to the payment method.

17. General Provisions

17.1 Entire Agreement

These Terms constitute the entire agreement between you and Coloromi regarding your use of the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.

17.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of Coloromi.

17.3 Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

17.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and of no effect. We may assign or transfer these Terms, at our sole discretion, without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, or any other cause beyond our reasonable control.
