Welcome to Coloromi ("we," "our," or "us"). By accessing or using our website (coloromi.com), mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Coloromi regarding your use of the Services.

Please read these Terms carefully before using our Services. If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

By using our Services, you represent and warrant that:

  • You are at least 13 years of age (or the minimum legal age in your jurisdiction to use online services)
  • If you are under 18 years old, you have your parent's or legal guardian's permission to use the Services and they have read and agree to these Terms on your behalf
  • You have the full right, power, and authority to agree to and be bound by these Terms
  • You are not prohibited from using the Services under the laws of the United States or any other applicable jurisdiction

3. Account Registration

To access certain features of our Services, you may need to register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to or use of your account
  • Take responsibility for all activities that occur under your account

We reserve the right to disable any user account at any time, including if we believe you have violated these Terms.

3.1 Email Verification

We may require email verification as part of the registration process. You agree to receive a verification email and complete the verification process to fully activate your account. If you do not verify your email within the specified timeframe, certain features of your account may be limited.

3.2 Account Security

For your account security, we implement the following measures:

  • Rate limiting on login attempts to prevent unauthorized access
  • Password encryption using bcrypt technology
  • Automatic account lockouts after multiple failed login attempts
  • Session management to protect against unauthorized access

You are responsible for maintaining the security of your account credentials and must notify us immediately of any unauthorized access.

4. Credit System and Payments

Our Services operate on a credit-based system subject to the following terms:

  • New users receive 1 free credit upon account creation
  • Each credit allows for the generation of one coloring page
  • Credits must be purchased through our platform
  • Credits do not expire and remain valid until used
  • Credits are non-transferable and non-refundable, except as required by law
  • We reserve the right to modify the credit system, including pricing and functionality, at any time

4.1 Credit Packages

We offer the following credit packages:

  • Starter Package: 8 credits for $5.00 USD
  • Standard Package: 20 credits for $10.00 USD
  • Premium Package: 50 credits for $20.00 USD

All packages include permanent Pro status which provides access to additional features and higher usage limits.

4.2 Payment Processing

We use Stripe as our payment processor. By making a purchase, you agree to provide current, complete, and accurate payment information and authorize us to charge your chosen payment method for the products or services you have selected.

All prices are in US dollars unless stated otherwise. We reserve the right to adjust pricing at any time. Applicable taxes may be added to the purchase price as required by law.

4.3 Refunds

Due to the digital nature of our Services, all purchases are final and non-refundable, except in cases where:

  • The Services are unavailable for an extended period
  • We have made material changes to the Services that substantially reduce their functionality
  • Refunds are required by law

Refund requests should be submitted to [email protected] within 7 days of purchase.

4.4 Pro Account Benefits

Purchasing any credit package automatically upgrades your account to permanent Pro status, which includes:

  • Access to all style options (12+ unique styles)
  • Access to all themes and transformation options
  • Enhanced detail control (simple, medium, complex)
  • Special enhancement tools (symmetry, patterns, custom text)
  • Higher daily download limits
  • Premium quality coloring page outputs
  • Priority support

Pro status is permanent and does not expire even after using all purchased credits.

5. User Content

5.1 Content Ownership

You retain ownership of any images you upload to our Services ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, modify, create derivative works (such as coloring pages), and distribute your User Content for the purposes of operating, developing, and improving our Services.

5.2 Content Restrictions

You agree not to upload, transmit, or share User Content that:

  • Infringes upon intellectual property rights of any third party
  • Contains explicit, graphic, or inappropriate content (including nudity, violence, or offensive material)
  • Depicts recognizable individuals without their consent (or parental consent for minors)
  • Promotes discrimination, bigotry, racism, hatred, or harm against any individual or group
  • Is intended to harass, intimidate, or bully
  • Contains personal or confidential information of another person
  • Promotes illegal activities or contains malicious code
  • Violates any applicable law, regulation, or third-party right

We reserve the right to review, remove, or restrict access to User Content that violates these Terms or that we otherwise find objectionable, without prior notice.

5.3 Content Moderation

All user-uploaded content is subject to automated moderation using AI-based recognition technology. We use AWS Rekognition to scan images for inappropriate content including but not limited to nudity, violence, or offensive material. Images that fail our moderation checks will be automatically rejected, and repeated violations may result in account suspension or termination.

5.4 Public Gallery

By choosing to make your coloring pages public, you agree that they may be displayed in our public gallery and accessible to other users. You can control the visibility of your generated coloring pages through your account settings.

5.5 Data Retention

We may retain your User Content and any derivatives for as long as reasonably necessary for the purposes described in these Terms. Even after you delete your account, your public coloring pages may remain on the site.

6. Intellectual Property Rights

6.1 Our Content

The Services, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software), are owned by Coloromi, our licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

6.2 Generated Coloring Pages

The coloring pages generated through our Services are for personal, non-commercial use only, unless you purchase a commercial license. With a personal license, you may:

  • Print coloring pages for personal use
  • Share printed coloring pages with family and friends
  • Use coloring pages for educational purposes in non-commercial settings

You may not:

  • Redistribute, sell, or offer generated coloring pages through any other website, application, or service
  • Use the generated coloring pages for commercial purposes without a commercial license
  • Remove watermarks or attribution from generated coloring pages
  • Claim ownership or authorship of generated coloring pages

6.3 AI-Generated Content

The coloring pages generated by our AI technology may be based on multiple sources and training data. By using our Services, you acknowledge that:

  • AI-generated coloring pages do not infringe on any third-party copyright by nature of their transformation and original creation
  • We cannot guarantee absolute uniqueness of every generated design
  • While you receive a license to use the coloring pages as specified in these Terms, the underlying AI models and generation technology remain our property
  • Our AI models are trained on properly licensed data and have been designed to create original content rather than reproduce existing works

6.4 Collections and Organization

Our Services allow you to organize coloring pages into collections and create colored versions of coloring pages. You retain ownership of any colored versions you create using our Services, subject to the limitations on the underlying coloring page rights described in these Terms.

7. Prohibited Activities

You agree not to:

  • Use the Services in any manner that could disable, overburden, damage, or impair the Services
  • Use automated scripts, bots, or other software to access or interact with our Services
  • Attempt to circumvent any access restrictions or security measures
  • Engage in any activity that interferes with or disrupts the Services
  • Use the Services to develop competing products or services
  • Attempt to decompile, reverse engineer, or disassemble any portion of our Services
  • Use the Services for any illegal purpose or in violation of any law
  • Impersonate another person or misrepresent your affiliation with any person or entity
  • Attempt to bypass our rate limits, content moderation, or anti-abuse measures
  • Create multiple accounts to circumvent usage limitations or account restrictions
  • Engage in excessive downloading of content using automated means
  • Conduct systematic scraping of our website or gallery

7.1 Rate Limiting and Usage Restrictions

To ensure fair usage of our Services, we implement various rate limits, including but not limited to:

  • API request limits (60 requests per minute for authenticated users, 20 requests per minute for anonymous users)
  • Login attempt limits (10 login attempts per 5 minutes)
  • Registration limits (3 new accounts per hour from the same IP address)
  • Download limits (10 downloads per minute for anonymous users, 20 downloads per minute for authenticated users)
  • Daily maximum downloads based on account type (higher limits for Pro users)

Exceeding these limits may result in temporary restrictions on your ability to use certain features of the Services.

7.2 Account Restrictions

We may restrict your account in various ways if we detect violations of these Terms or suspicious activity:

  • Hard Ban: Complete restriction of account access
  • Soft Ban: Silent restriction of specific actions without notifying you
  • Feature-specific Restrictions: Limiting your ability to generate new pages or download content
  • IP Ban: Restricting access from specific IP addresses in cases of systematic abuse

Repeated or severe violations may result in permanent account termination.

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information when you use our Services. By using our Services, you consent to the collection, use, and sharing of your information as outlined in our Privacy Policy.

8.1 Data Collection and Processing

We collect and process the following information to provide our Services:

  • Account information (name, email, password)
  • User-uploaded images and generated coloring pages
  • Usage data and interaction with our Services
  • Payment information (processed securely through Stripe)
  • IP addresses and device information for security and analytics

We implement appropriate technical and organizational measures to protect your personal information against unauthorized or unlawful processing.

8.2 Cookies and Similar Technologies

Our website uses cookies and similar technologies to enhance your browsing experience and analyze site usage. When you first visit our site, you will be presented with a cookie consent banner that allows you to choose which types of cookies you accept:

  • Essential Only: Only cookies necessary for the website to function properly will be used.
  • Accept All: All cookies, including analytics and functional cookies, will be used.

Your choice will be stored for one year, after which you will be asked again. You can learn more about our cookie usage in our Privacy Policy. You may change your cookie preferences at any time by clearing your browser cookies and revisiting our site.

8.3 Data Security

  • Limited access to user data by our staff

Despite our efforts, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.

9. Third-Party Services

Our Services may integrate with or contain links to third-party websites or services. We do not control and are not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge that your use of such third-party services is governed by their terms of service and privacy policies.

9.1 Third-Party Integrations

Our Services use the following third-party services and integrations:

  • Stripe: For payment processing
  • AWS S3: For storage of user-uploaded images and generated coloring pages
  • AWS Rekognition: For content moderation of user-uploaded images
  • OpenAI API: For AI-powered coloring page generation
  • Redis/Upstash: For rate limiting and caching

Your use of these third-party services is subject to their respective terms and privacy policies.

10. Disclaimers

10.1 No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10.2 AI-Generated Content

The coloring pages generated by our Services use artificial intelligence technology, which may produce unexpected or imperfect results. We do not guarantee that the generated coloring pages will meet your specific requirements or expectations.

10.3 Content Moderation

While we employ automated systems to detect inappropriate content, these systems are not infallible. We do not guarantee that all inappropriate content will be detected or that appropriate content will not be erroneously flagged.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL COLOROMI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN ANY EVENT, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO COLOROMI DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Coloromi, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Services
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claim that your User Content caused damage to a third party

13. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If your account is terminated, we may delete any User Content or other information associated with your account.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13.1 Account Deletion

You may request deletion of your account through your account settings. Upon deletion:

  • Your personal information will be removed from our active databases
  • Your private coloring pages will be deleted
  • Public coloring pages you have created will remain on the site
  • Your username may be retained to preserve attribution of public content
  • Usage logs and anonymized data may be retained for analytics purposes

We will process your account deletion request within 30 days.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Services shall be finally settled by binding arbitration. The arbitration shall be conducted under the rules of the American Arbitration Association and judgment on the arbitration award may be entered in any court having jurisdiction.

Any arbitration under these Terms will take place on an individual basis; class arbitrations and class actions are not permitted.

16. General Provisions

16.1 Entire Agreement

These Terms constitute the entire agreement between you and Coloromi regarding your use of the Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.

16.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of Coloromi.

16.3 Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

16.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and of no effect. We may assign or transfer these Terms, at our sole discretion, without restriction.
